1. Introduction

Welcome to Rubiks-dev.com. These Terms of Service ("Terms") govern your use of our website and services provided by Rubiks Development d.o.o. ("Rubiks", "we", "us", or "our"), located at Starine Novaka 22, 11120 Belgrade, Serbia. By accessing our website or engaging our services, you agree to be bound by these Terms.

2. Services

Rubiks provides software engineering, consultancy, and digital marketing services. The specific scope of work, deliverables, and timelines for any project will be defined in a separate Statement of Work (SOW) or Master Services Agreement (MSA) signed by both parties.

In the event of a conflict between these Terms and a specific SOW/MSA, the terms of the SOW/MSA shall prevail.

3. Intellectual Property

Our IP: All content on this website, including code, design, text, and graphics, is the intellectual property of Rubiks and is protected by copyright laws.

Client IP: Upon full payment of all fees, Rubiks assigns to the Client all right, title, and interest in the custom code and deliverables created specifically for the Client under an SOW, excluding any pre-existing background technology or open-source components.

4. Confidentiality

We treat all client data as strictly confidential. We will not disclose your proprietary information to third parties without your written consent, except as required by law. We expect the same level of confidentiality regarding our proprietary methodologies and pricing.

5. Limitation of Liability

To the fullest extent permitted by law, Rubiks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or in connection with our services. Our total liability for any claim arising under these Terms shall not exceed the amount paid by you to us in the six (6) months preceding the claim.

6. Payment Terms

Unless specified otherwise in an SOW, invoices are due within 14 days of receipt. We reserve the right to suspend services for accounts that are more than 30 days overdue.

7. Governing Law

These Terms are governed by the laws of the Republic of Serbia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Belgrade, Serbia.
